Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cohort Atlas website, Operator Console, APIs, and related services (collectively, the “Service”) provided by Cohort Atlas (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Service Description
Cohort Atlas provides traffic intelligence products derived from anonymized, aggregated GPS mobility data. Our offerings include corridor-level traffic volume estimates, truck stop diesel volume estimates, competitive benchmarking, and related analytical tools. All estimates are statistical in nature and are provided with confidence intervals where applicable.
2. Eligibility and Accounts
The Service is available to businesses and individuals who are at least 18 years old. The Operator Console requires an invitation from Cohort Atlas and authentication via Google OAuth. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You agree to provide accurate information when creating your account and to notify us promptly of any unauthorized access or security breach.
3. Acceptable Use
You agree not to:
- Use the Service to attempt to identify, track, or surveil any individual person or device
- Reverse-engineer aggregated data to isolate individual-level records
- Redistribute, resell, or sublicense Service data without written authorization
- Scrape, crawl, or use automated means to extract data from the Service beyond normal API usage
- Use the Service in violation of any applicable law or regulation
- Interfere with or disrupt the Service or its infrastructure
- Misrepresent your identity or affiliation when creating an account
4. Data You Provide
When you submit operational data (such as diesel gallons, transaction counts, or other business metrics) through the Operator Console, you retain ownership of that data. By submitting it, you grant Cohort Atlas a non-exclusive, royalty-free license to use, process, and incorporate that data into our models for the purposes of:
- Calibrating and improving your site’s estimates
- Improving the accuracy of our models for other sites (in anonymized, aggregated form only)
- Generating anonymized competitive benchmarks (your data is never individually identifiable to other users)
You may request deletion of your submitted data at any time by contacting us.
5. Estimates and Disclaimers
All traffic and volume estimates provided by the Service are statistical estimates, not measured values. They are derived from sampled GPS data and are subject to uncertainty. Confidence intervals and calibration scores are provided to help you assess reliability.
THE SERVICE AND ALL DATA, ESTIMATES, AND ANALYTICS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY. WE DO NOT WARRANT THAT ESTIMATES WILL BE ERROR-FREE OR THAT THE SERVICE WILL BE UNINTERRUPTED.
6. Intellectual Property
The Service, including all software, models, methodologies, user interfaces, documentation, and branding, is owned by Cohort Atlas and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property.
You may use Service outputs (estimates, reports, charts) for your internal business purposes. Public redistribution of bulk data or model outputs requires written permission.
7. Confidentiality
Certain data shown in the Operator Console—including site-level estimates, competitive benchmarks, and model component scores—is confidential to your account. You agree not to publicly disclose other operators’ data or attempt to identify competitors from anonymized benchmark data.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COHORT ATLAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You acknowledge that estimates are statistical in nature and agree not to rely on them as the sole basis for business decisions involving significant financial commitment without independent verification.
9. Indemnification
You agree to indemnify and hold harmless Cohort Atlas, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, violation of these Terms, or infringement of any third party’s rights.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason with 30 days’ notice. You may close your account at any time by contacting us. Upon termination, your right to access the Service ceases, but provisions that by their nature should survive (including Sections 5, 6, 8, 9, and 12) will continue in effect.
11. Modifications
We may modify these Terms at any time. We will notify registered users of material changes via email at least 15 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the modified Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in Palm Beach County, Florida. The arbitrator’s award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
Notwithstanding the foregoing, either party may seek injunctive or equitable relief in the state or federal courts located in Palm Beach County, Florida, to protect intellectual property rights or prevent irreparable harm, and both parties consent to the exclusive jurisdiction of those courts for such purposes.
